The duties of the Clerk of Court, a member of the judicial branch, are detailed in Iowa Code Sections 602.8101 through 602.8109. The District Court Judges appoint the Clerk, who must take the oath of office outlined in Iowa Code Section 63.10 and post a bond by Chapter 64’s provisions.

The independent judicial arm of each state and the federal government is responsible for interpreting and applying state and federal laws to particular situations. The judicial branch aids in preserving peace and order in society by offering a venue where individuals may go to settle disagreements under the law, through a fair procedure, and in front of a qualified and impartial judge or jury.

O’BRIEN COUNTY, IOWA COUNTY CLERK/RECORDER DATABASE

Legal disputes, including contracts, real estate, personal injuries, child custody, support, and visitation, among other significant matters, are all handled by the courts. Additionally, courts decide if traffic, criminal, or juvenile laws have been broken, and if so, what punishments should be applied.

In these matters, petitions, pleadings, orders, etc., are filed with the clerk of court, who keeps track of the docket. The docket was manually maintained until October 31, 1996. The Clerk of Court’s office started electronically docketing this information on November 1, 1996.
