NESS COUNTY, KANSAS COUNTY CLERK/RECORDER DATABASE

The County Clerk serves a particular function in county government since the Kansas Constitution and Statutes of Law provide the elected post a significant degree of legal duty. The office is divided into several sections:

1. Office of Record for the Board of County Commissioners (BOCC): The County Clerk serves as the BOCC’s secretary, either in person or through a deputy; she maintains the board’s seal, documents its proceedings, attests its signature with the county seal, and serves as the repository for all Board records.

2. County Clerk: The County Clerk oversees all local elections and voter registration.

3. Tax administration: The county’s real estate and personal property assessments must be finalized by the county clerk. Special checks are made when the tax levy amounts are decided upon in October, and the County Clerk then creates the tax register and tax statements. All newly constituted taxation districts are reported to the appraiser and treasurer offices, who are also given updated maps each year that reflect changes.

4. Financial Management: By law, the County Clerk is responsible for keeping track of all claims against the County, certifying that there is enough money in the budget and cash reserves to pay for all claims, and charging the County Treasurer with the claim payments. To submit the claims to the County Commissioners, the Clerk must be well-versed in the budgets and expenditures of all County departments. For the accounting of all payments and expenditures, the Clerk must maintain a transparent audit trail for audit purposes. Each month, all account payables are prepared for settlement. The county clerk ensures that all the different taxing bodies have created legitimate budgets and sends copies of each budget to the state. The county clerk assists as the auditor gathers data for the yearly audit.
